After discoursing on the evolution and consolidation of the general principles of law in the legal system, foreign and domestic, the present study emphasizes the role of these principles by examining the applicability and pointing out its functions. Set the premise that the general principles of law the system are central figures fitted with normativities, in the current phase post positivist, the study is devoted to the analyzes of good faith, especially in its objective aspect: (i) the evolution of the institute; (ii) its importance to the Civil Law, and also for the system, and (iii) its current design. Completed this step, follows a brief introduction about the relatively recent phenomenon of “constitutionalization of civil law”. During this stage, it is demonstrated the need for reinterpretation of the Civil Law vis-à-vis the constitutional rules. Finally, it is discussed the question of empirical relevance and still without a uniform solution in doctrine and court precedents concerning the application of good faith expressly linked to general principles of law, notably the principles of solidarity and human dignity(Articles 1º, item III and Article 3, item I, of the Federal Constitution)
