Resumo: The present work studies the relevance of objective good faith in pre-contractual relations in civil and business law and the impacts resulting from its infraction. To this end, an analysis of legislation, doctrine and jurisprudence is carried out - this in order to bring an example - on the subject. It was found that, even with Brazilian law expressly stating that good faith must be maintained between the parties before the contract is formed, its application differs in each specific case. The present work sought to bring a touch of this doctrinal universe that has been increasingly looking at the maintenance of good faith between the parties during the negotiations

Para tanto, é realizada análise de legislação, doutrina e jurisprudência – esta de forma a trazer um exemplo – sobre o tema. Constatou-se que, mesmo com a lei brasileira trazendo de forma expressa que a boa-fé deve ser mantida entre as partes antes da formação do contrato, sua aplicação difere a cada caso concreto.
