This monograph aims to address the various dimensions of the security measure, a criminal sanction that applies to individuals who, once criminalized, have been diagnosed with a mental disorder and are considered legally non-responsible (unaccountable). Unaccountability is not subject to the retributive nature of punishment, but rather to the society's defense model, which understands that the agent responsible for the offense should be contained until the cessation of his dangerousness – a period during which curative treatment will be applied. The enactment of Law No. 10,216/2001 further highlighted the ineffectiveness of incarcerating these patients, who are isolated, discriminated against, and frequently have their rights violated in Hospitals for Custody and Psychiatric Treatment (HCTP)
