The aim of the present study is to show the important role to be played by the Brazilian Solid Waste Policy, with emphasis on municipal action. Forthermore, the project goes throught some fundamental rights, highlighting article 225 os the Federal Constitution and the social rights guaranteed by the Major Law, which is the basis of every legal system. It also combines the elementary principles of the environmental law, that are extremely important the overall understanding of the issue. It aggregates, through the historical evolution of the rules of state Solid Waste Policy, which have always focused on this matter in a relevant way. I consider, subsequently, environmental education and its application in the National Solid Waste Policy. I then examine the municipality and its role in the juridical system and analyze the key points of the Policy, including the Municipal integrated management plan and reverse logistics. I adduce the problems of pollution by solid waste in view of social rights such as the right to health, among others, welfare. In addition, I discuss the principle of “reserve do possível” (“Vörbehalt dês Moglichen”) and allocation of the budget, destined to ensure the right to health and compliance with the Supreme Court. Last, but not least, I discuss the economic instruments with special attention to the National Solid Waste Policy
