This study was made with the purpose of analyzing the possibility of the Higher Court, due to the filling of an Appeal, proceeds with the immediate judgment of the matter’s purpose, once the original Judge did not fulfilled such judgment, for not being presented all the necessary conditions for so. We will try to analyze the main matters and procedural institutes that are related to the theme, especially those regarding the form on which the Appeal is processed by the Court of Appeals, specially the effect that the filling of the Appeal triggers to the lawsuit and the possibility of such positive conduction by the Court enable a decision that might be unfavorable to the party that filed the Appeal (“reformation in peius”). The study will be conducted through the analyze of the former Brazilian Civil Procedure Code, together with the actual one, always in order to enable a comparative review among them, always guided by Court decisions and the best studies regarding this theme.
