Resumo: The delay in adjudication and dissatisfaction arising from different jurisdictional provisionses for identical rights crises can not have more space now. In an attempt to solve these wo unds that transcend the judiciary, a number of legislative innovations, not only in Brazil, which shook the legal community. One of them was the creation of Repetitive demands Resolution Incident. Within this reality this study seeks to analyze the mentioned institute. It presented a systematic and teleological interpretation of the rules that correlate with this mechanism, the result of a thorough front analysis to the legal system, so that makes it possible to envision the legitimacy and effectiveness in achieving its main purpose - legal certainty and equal jurisdictional provision -. In addition, this paper analyzes the IRDR compatibility with constitutional procedural principles

Na tentativa de solucionar estas chagas que transcendem o Poder Judiciário, houve uma série de inovações legislativas, não só no Brasil, que agitaram a comunidade jurídica. Uma delas foi a criação do Incidente de Resolução de Demandas Repetitivas. Dentro dessa realidade este estudo procura analisar o mencionado instituto. É apresentada uma interpretação sistemática e finalística das normas que se correlacionam com este mecanismo, resultado de uma análise minuciosa frente ao ordenamento jurídico, de modo que torna possível vislumbrar-se a legitimidade e efetividade na realização de seu propósito maior – segurança jurídica e igualdade no provimento jurisdicional –.
