O poder geral de efetivação e a legitimação das medidas executivas atípicas no modelo de estado constitucional de direito: uma análise dos arts. 139, iv e 536 §1º do código de processo civil

Resumo: | This work adresses a set of historical, philosophical and theoretical issues relating to the effectiveness of condenatory protections, after the procedural law expressly raise the right to satisfying activity at the level of fundamental right. We adopted the model of Constitutional Civil Procedure, from the perspective of the Professor Humberto Ávila, for whom the Originary Constituent Power chose to elaborate a regulatory Constitution, with more rules than principles. It was verified that the legislative power at the year 2015 embraced the ideals of a neoconstitutional philosophy, extending the freedom of the magistrates in the exercise of the satisfying activity, in regard to the crisis of inefficiency that was instated in the Judiciary Power. We conclude that, in the Constitutional State of Law, the right to a satisfying activity will be guaranteed when the State-Judge, at the moment of delivering judicial protection, respect the boundaries imposed by the normative postulate of due process of law and the postulate of the effectivity, as well as the procedural rules resulting therefrom |

Foi adotado o modelo de Processo Civil Constitucional, sob a ótica do Professor Humberto Ávila, para quem o Poder Constituinte Originário optou por elaborar uma Constituição regulatória, com mais regras que princípios. Verificou-se que o legislador processual de 2015 abraçou os ideais de uma filosofia neoconstitucional, ampliando a liberdade dos magistrados no exercício da atividade satisfativa, ante a crise de ineficiência que se instaurou no Poder Judiciário.
