The guiding moral principles of society condemn one who shies away from their responsibilities, especially in nasty attitude conscious and oblivious to the detriment of shareholders. Since Roman law, the legal system seeks ways to curb such behavior, creating an universal institute: the fraud against creditors. With the evolution of this institution, together with the need to ensure the effectiveness of judicial assistance occurred the specification or specialization of hypotheses, emerging the institute the fraud enforcement. This dissertation will demonstrate, modestly, the evolution of the institution of defrauding creditors, in order to clarify the origin of the fraud enforcement, intending to demonstrate in that distanced himself from the institute that originated it. Then, we will make an analysis of the legal, doctrinal and jurisprudential setting for this kind of fraud, and then examine some of the most controversial aspects faced by the law operator
