The scope of the present study is to clarify and demonstrate, through researches made in articles, the jurisprudence and doctrines, the meaning of the “Plea Bargain” procedure, its origin, judicial nature and prediction and application on Brazil´s legal order. We must also explain here, in a clear and precise way, the actions that must be adopted for its validity and effectiveness, when used by each one of the competent authorities. Lastly, we will address of the problematics that surround the procedure stated here, entering for this purpose, the discussions that include the (un)constitutionality of the referred theme. Furthermore, throughout the paper, as the theme and problematics that are being presented, we will rise and analyze some of the recent decisions published by our Superior Courts, including the ones from our Illustrious Supreme Court, to demonstrate the respective understandings adopted by them
