This monograph aims to present a new thesis about the legal regime of property in marriage. Although, currently, the Civil Code adopts partial community property as a legal regime, this monograph argues that, in fact, the total separation of property should be the legal regime to govern property relations in marriage. Therefore, it is necessary to go through the entire history of marriage, analyzing the evolution of women in society, which evidently interfered with the notions of marriage. By analyzing the history of marriage and, consequently, the types of regimes in marriage, one comes to the conclusion that, given the current situation, the regime of total separation of property is the one that best fits as a legal regime of property to prevail in the marriage, if intimates do not arrange otherwise. Indeed, given the current reality of marriage, with emphasis on the conflicts that arise when it breaks up, it would be more appropriate to change legislation to adopt the legal regime of property that of total separation, as will be seen throughout this monograph
