This study deals with the legal forest reserve compensation in conservation units of the State of São Paulo. It begins with the approach given by the Federal Constitution to the environment, following by the history of creation of specially protected territorial spaces, by the conservation units since the creation of the first park, the Yellowstone Park in the United States of America, until the ones recently established in the State of São Paulo. One chapter is dedicated to the National System of Conservation Units, which covers the objectives, directives and definitions given to the categories of conservation units it has created, as follows: of integral protection and of sustainable use. Furthermore, it deals with the conservation units of São Paulo State, showing the current status and providing information about the number of areas and the approximate size. It also makes a comparison between the legal reservation area that the Paulistan state must have, how much it effectively has and how much it could be registered using the legal reserve compensation in conservation units. The compensation of legal reserve was treated approaching the legal concept of legal reserve, together with the directive of the Forest Code that permits that this area be compensated in conservation units, indicating the conditions that it must occurs, and its advantages to the rural owner, to the Public Power and to the community, once this type of compensation helps maintaining an ecologically balanced environment to the present and to the future generations
