Resumo: The objective of this work is to analyze the expansion of the symbolic character of penal protection and establish its correlation with social changes within the contemporary world and its consequences within the criminal legal science, with the creation of an extremely punitive system that goes from meeting the precepts of the Democratic Rule of Law. Afterwards, solutions will be presented for the harmful effects of this unrestrained expansion of Symbolic Criminal Law, which seeks to reconcile the need to protect the new contemporary legal assets, respecting the fundamental rights consolidated by Democratic States. Finally, among the solutions presented, there will be the choice of the one that best matches the constitutional guarantees

Em seguida, serão apresentadas as soluções dos efeitos deletérios dessa expansão desenfreada do direito penal simbólico, que busca conciliar a necessidade de proteção dos novos bens jurídicos contemporâneos, respeitando os direitos fundamentais consolidados pelos Estados Democráticos.
