Resumo: The present work aims to study the possibility of the constitution of fiduciary alienation on fungible assets and, if this is not possible, how it would be possible to “unfungibilize” a fungible asset. For that, this dissertation will use the historical context of the real guaranteed institutes, in addition to including a brief analysis of the concept in our legal system of real law. We will also bring as a background the concept of fungible goods and fungible goods. In addition, we will use these situations in the capital market as an example, with the presentation of jurisprudence of recently judged cases. The dissertation will be based on our Civil Code and Law nº 4,728/65. More specifically, we will seek support from article 66-B of Law No. 4,728/65 for this discussion to take place
