Resumo: This paper aims to provide analysis of the currently Brazilian Copyright Law (No. 9.610 of 1998) thru the Diffuse Rights, developing an embracing interpretation which establishes that the intellectual property, which carries out the all the ideas, has a legal nature of Diffuse Rights. Furthermore, this paper also aims present how the new technologies, especially the internet, contributed to the advances of a democratic and collaborative society, as well how the new technologies impacted on the protection of copyright. The dichotomy between the development of a cultural society and the protection of copyright allows the development of projects and ideas which aim to solve this impasse. Among these projects it´s possible to mention the Creative Commons and the opens source software

Among these projects it´s possible to mention the Creative Commons and the opens source softwareO pressente trabalho faz de uma análise da atual Lei de Direitos Autorais Brasileira (Lei nº 9.610/1998) através dos Direitos Difusos, concebendo uma interpretação abrangente em que a Propriedade Intelectual, que concretiza o conteúdo das ideias, tem natureza de Direto Difuso. Ademais, a análise feita por este trabalho também apresenta como as novas tecnologias, em especial a internet, contribuíram para avanços no desenvolvimento de uma sociedade democrática e colaborativa, bem como isto impacta com a proteção dos Direitos Autorais. Nesta dicotomia entre o desenvolvimento de uma sociedade cultural, e a proteção dos Direitos Autorais, surgem projetos que visam solucionar este impasse, bem como propor uma nova forma de encarar os Direitos Autorais.
