Resumo: The professional freedom right prescribed in the Constitution of Brazil is not absolute, since it is a State duty to assure that the adequate skills are fulfilled, according to the law. The purpose of this essay is studying the structure through which this state interference on private affairs is operated and how it is performed. First, it will be made a history retrospect research and a juridical and structural analysis of the institutions responsible for that assignment, according to the law, the doctrine and the jurisprudence. Next, there will be an examination of the professional activities regulation regime, studying the juridical means to exercise the control over some professions on behalf of the public interest
