This research seeks to study the existing controversy about the safety measures, issues that are not peaceful and that are, on one side, a conservative and traditional thinking of our Courts, and the other, more humanitarian judgmental thoughts, seeking more than comply with the law, seek to give the law its real meaning: to ensure the public purpose it was intended. Without exhausting the subject, this work has the scope to address the constitutional precepts and principles before the application of the security measure, in this particular, then, arises the question of the constitutionality of the temporal indeterminacy of the measures, the central theme of this presentation that generates constant doctrinal conflicts and case law in our legal system. It is intended, therefore, a severe reflection on the problems involving madness and responsibility (or irresponsibility) of the State about the mentally ill
