The solid waste issue in Brazil has only recently gained a specific legal instrument that provides its protection. In fact, the National Policy on Solid Waste presents guidelines to address the problem of inadequate disposal of solid waste, and among its precepts is the recognition of waste pickers as important environmental agents who contribute to selective collection, reverse logistics and recycling. The NPSW decree provides the Payment for Environmental Services as an economic instrument to promote its objectives. This work seeks to analyze the legal aspects of the concepts related to PES as a system for remuneration to services provided by waste pickers, as well as the main attributes of some of the experiences and proposals presented on this matter. Therefore, there is a certain unanimity regarding the need for constitution of waste pickers in cooperatives and associations, in order to promote their instrumentalization, and to facilitate income transfer, contributing for this socioeconomic chain’s sustainable development. On the other hand, within the PES systems studied, there are distinctions’ regarding payment and provision methods, assigning these to the government or to the private initiative, singly, which is questioned due to the shared responsibility principle. Thus, it is sought to outline the legal requirements for the use of PES as an incentive to the activity of waste picking, and as an instrument capable of empower and emancipate this portion of the population
