This work has the objective of analyzing the teleology and axiology concerning the law number 12.305 of 2 of august of 2010, which is responsible for the regulation of the National Policy of Solid Residues. Inside the field of Environmental Law, the treatment of solid residues must be integrated to the other areas of law and the study of its principles and objectives has as an objective to determine the orientations of the rules which concern the destination of these residues and the diminishing in its production with the goal of reaching a sustainable environment. The Federal Constitution, ensures the right to a sustainable environment in its article 225. Between the necessities that this concept need to ensure is the adequate destination of solid residues which is regulated by the National Policy of Solid Residues. Notwithstanding, the brazilian judicial order utilizes principles and values that help the operator of law to correctly apply the norms in a reasonable manner, in a way that its application does not mean the ignorance of another one, in the same way it must also be done with the law that establishes the National Policy of Solid Residues
