O doping no sistema jurídico-desportivo brasileiro sob a égide do novo código mundial antidoping

Resumo: With the entry into force on January 1st, 2015 of the new world anti-doping code of the World Anti-Doping Agency - WADA, the sports world is experiencing a new search engine for healthiness in competitions. The recasting of the rules, the new code has brought new perspectives and an apparent resurgence of the penalties applicable to all those inside in the sports world and engaged, directly or indirectly, in this matter. Regarding Brazil, this redesign aligns with the 2016 Olympic and Paralympic Games in the city of Rio de Janeiro, and brings up some questions, mainly as to verify if our country is prepared, under a technical and legal point of view, to implement the provisions relating to the fight against doping and to effectively verify and identify violations for improper use of performance-enhancing drugs. That is, is the application and internalization of the new World Anti-Doping Code by Brazil, on the eve of the 2016 Olympic and Paralympic Games, legally appropriate, especially considering the long period when the country was without a laboratory duly accredited by the World Anti-Doping Agency? Therefore, there are solid reasons to investigate the issue, since controversial and worthy of wide debates

A reformulação das regras, pelo novo código, trouxe novas perspectivas e um aparente recrudescimento das penas aplicáveis a todos aqueles inseridos no mundo desportivo e que atuam, direta ou indiretamente, nesta seara. No que diz respeito ao Brasil, essa reformulação alinha-se com a realização dos Jogos Olímpicos e Paraolímpicos de 2016 na cidade do Rio de Janeiro, e traz à baila alguns questionamentos, principalmente no sentido de se verificar se nosso país se encontra preparado, sob o ponto de vista técnico e legal, para aplicar as disposições relativas ao combate à dopagem e a efetivamente verificar e identificar infrações por uso indevido de substâncias dopantes. É dizer, a aplicação e internalização do novo Código Mundial Antidoping pelo Brasil, às vésperas dos Jogos Olímpicos e Paralímpicos de 2016, está legalmente adequada, especialmente considerando o longo período em que o país esteve sem um laboratório devidamente credenciado pela Agência Mundial Antidoping?
