Resumo: The present thesis aims to understand the logic behind lex mercatoria, which in essence, was associated to jus mercatorum, and nowadays, can be considered an order transnational, polycontextural, heterarchical, soft law; The objective is to establish a new perspective for the theme as a social subsystem, and to defend that it is possible for lex mercatoria to assume another rationality as a global economic law, which is not necessarily the one from economics or politics, moreover that lex mercatoria it is not fated to be corrupted by these systems, and when confronted, it can guide its programs to apply social values, rather than just economic calculations. In order to corroborate this thesis, the lex mercatoria was inserted in the context of autopoietic systems theory, aiming to investigate it as a social subsystem that coexists in global society with a plurality of other systems and transnational legal orders. The theory of self-referential systems allows us to detect the conflicts arising from the relation of lex mercatoria with other global social system and to evaluate the risk of systemic corruption, in addition to claim the autonomy of lex mercatoria as an autopoietic right. This theory has the quality of adopting new descriptions for social phenomena, in the case of lex mercatoria, it allows to identify a new legal order, reoriented by principles and social values promoted by the global civil society itself, that can prevail in the conflicts that involve lex mercatoria. For accomplish this work, theoretical research techniques were adopted, based mostly on bibliographical research, but also on deductive reasoning, with the development of sequence of arguments along the thesis content, each one to prove a step of the discourse

In order to corroborate this thesis, the lex mercatoria was inserted in the context of autopoietic systems theory, aiming to investigate it as a social subsystem that coexists in global society with a plurality of other systems and transnational legal orders. The theory of self-referential systems allows us to detect the conflicts arising from the relation of lex mercatoria with other global social system and to evaluate the risk of systemic corruption, in addition to claim the autonomy of lex mercatoria as an autopoietic right. This theory has the quality of adopting new descriptions for social phenomena, in the case of lex mercatoria, it allows to identify a new legal order, reoriented by principles and social values promoted by the global civil society itself, that can prevail in the conflicts that involve lex mercatoria. For accomplish this work, theoretical research techniques were adopted, based mostly on bibliographical research, but also on deductive reasoning, with the development of sequence of arguments along the thesis content, each one to prove a step of the discourseA presente tese busca compreender a lógica da lex mercatoria que, na sua essência, esteve atrelada ao jus mercatorum e, atualmente, pode ser considerada uma ordem jurídica transnacional, policontextural, heterárquica, soft law. O objetivo é estabelecer uma nova perspectiva para o tema enquanto subsistema social e defender que é possível à lex mercatoria assumir outra racionalidade, enquanto direito econômico global, que não seja necessariamente a da economia ou da política, mas, mais do que isso, que ela não está fadada a ser corrompida por esses sistemas, podendo, quando confrontada, orientar seus programas para aplicar valores sociais ao invés de cálculos econômicos tão somente. Com o intuito de corroborar esta tese, optou-se por inserir a lex mercatoria no contexto da teoria dos sistemas autopoiéticos, a fim de investigá-la como subsistema social que convive na sociedade global com uma pluralidade de outros sistemas e ordens jurídicas transnacionais. A teoria dos sistemas autorreferenciais permite detectar os conflitos que surgem do entrelaçamento da lex mercatoria com outros sistemas sociais globais e o risco da corrupção sistêmica, além de afirmar a autonomia da lex mercatoria enquanto direito autopoiético. Essa teoria tem por mérito adotar novas descrições para os fenômenos sociais e, no caso da lex mercatoria, permite que se identifique uma nova ordem jurídica, reorientada por princípios e valores sociais fomentados pela própria sociedade civil global, que pode prevalecer nos conflitos que envolvem a lex mercatoria. Para a realização deste trabalho, foram adotadas técnicas de investigação teórica com base, em grande parte, na pesquisa bibliográfica e o raciocínio dedutivo, na medida em que foi desenvolvido por intermédio de uma sequência de argumentos, cada um deles para provar uma etapa do discursoapplication/pdfhttp://tede2.pucsp.br/tede/retrieve/48742/Elaine%20Cristina%20Pardi%20Domingues.pdf.jpgporPontifícia Universidade Católica de São PauloPrograma de Estudos Pós-Graduados em DireitoPUC-SPBrasilFaculdade de DireitoLex mercatoriaAutopoieseTeoria dos sistemasConflitosLaw merchantAutopoiesisSystem theoryConflictsCNPQ::CIENCIAS SOCIAIS APLICADAS::DIREITOA Lex mercatoria na teoria dos sistemas sociais autopoiéticos: conflitos entre racionalidadesinfo:eu-repo/semantics/publishedVersioninfo:eu-repo/semantics/doctoralThesisinfo:eu-repo/semantics/openAccessreponame:Biblioteca Digital de Teses e Dissertações da PUC_SPinstname:Pontifícia Universidade Católica de São Paulo (PUC-SP)instacron:PUC_SPTEXTElaine Cristina Pardi Domingues.pdf.txtElaine Cristina Pardi Domingues.pdf.txtExtracted texttext/plain547703https://repositorio.pucsp.br/xmlui/bitstream/handle/22068/4/Elaine%20Cristina%20Pardi%20Domingues.pdf.txt36cb0d80712935f8dea2f53fe8f74b9bMD54LICENSElicense.txtlicense.txttext/plain;
