Resumo: This work aims to elucidate the role of the courts from the perspective of the theory of social systems developed by the German sociologist Niklas Luhmann. Based on the essential concepts of systems theory, the objective is to demonstrate the position of the courts in the system of law in view of their functional differentiation and their own attributes. Once this position is understood, the development of the Court of Arbitration for Sport as an autonomous and independent organization is examined, given the complexity and specificity of sport, under a necessary historical bias
