The new role of the State which was brought forth by the current Federal Constitution (CF) compels that it not only guarantee, but also put the social rights into effect. This lead to a new set of problems that had not existed before, such as how to provide the rights of distributive nature that everyone is entitled. Although this is not a new responsibility, it still presents uncertainties and distinct interpretations concerning its scope, especially regarding the way to require the accomplishment of this new responsibility. This work discusses the role of the State concerning the duty of health , included in the CF. Primarily questioning if pharmaceutical assistance services, and the right of medicines to be provided by the State, are included in duty of health based on the warranty and advantages guaranteed by the Consumer Legislation. To study this State responsibility and its scope, this work discusses what would be the right of health and conjecture as to the form of its effectiveness, by performing a critical analysis of the interpretation of that right by the Judiciary power. This generally considers the conflicts under the individual perspective, according to Commutative Justice, without taking into the consideration that it is Social Law, applied to the whole society, where the rule to be applied should be Distributive Justice. Finally, this work analyzes the conclusion reached and the demand for drugs presented by the people, in an attempt to formulate a practical applicability, while considering that it is a right f the whole society, and that man and their dignity is the paradigm established as the central by the CF
