Resumo: Taking into account that arbitration has a jurisdictional nature and that there is an arbitral process, this essay aims to demonstrate that the constitutional model of process must be applied not only to the classic judicial process, but also to the arbitral process. Given this fact, the paper states that the constitutionals principles of law with procedural aspects have to play a significant role in arbitration, that is to say, the interpretation of the arbitral process’ institutes and of the Brazilian Arbitration Act should be done considering the values contemplated in the Federal Constitution. With no further desire to end up the discussion regarding this subject, the goal of this essay is basically to systematize the arbitral process in the lights of the constitutional law
