The 1980s is an important milestone in Brazil's history, especially with regard to the struggles and democratic achievements. A struggle for social issues in favor of the redemocratization of the Brazilian State is one of the elements that characterize this decade in which, from numerous negotiations, the 1988 Constitution of the Citizen was conquered. The Magna letter recognizes and establishes the rights of Brazilian citizens, representing a notable advance in social rights. Among these rights, there is popular participation and administrative political decentralization, which, in turn, guaranteed society a segment of fiscalization and control of social policies. This same time clipping also sets up like an important moment to people with disabilities. It is a period of effervescence of the political movement of this social segment, that also carried out the democratic transition, and, since then, has been fighting for the recognition of civil, political and social rights in Brazil. No doubt, it can be said that the legal advances of this movement have been of great importance, regarding the historical trajectory permeated by exclusion processes of this people. In this research, it will be seen the challenge posed to the political movement of people with disabilities: the construction of spaces for participation and democratic social control of social policies in Brazil. With three decades of experience, the Municipal Council of People with Disabilities in the City of São Paulo has faced different tensions and challenges.
