This thesis deals with the non-derogable rights in the constitutional order in the light of the multi-level legal system of protection of fundamental human rights. For both from a historical evolution, draws the distinction between Human Rights and Fundamental Rights, and as a historical cut the Magna Carta of 1215 to the neoconstitutionalism through multi-level legal system. It also presents, as the non-derogable rights is treated in international and regional protection of human rights system since its protection through the global system, through the inter-American system, European, African and Asian protection. Furthermore, it does the evolution of the constitutional system in Latin America, especially the changes occurred in Chile, Colombia, Argentina and Bolivia. To then analyze the non-derogable rights in the constitutional history of Brazil to the Constitution of 1988 finally analyzing the jurisprudence of the Supreme Court in cases involving conflict of infra-constitutional norms with international human rights standards, proposing the creation of a International constitution with a respective International Constitutional Court seeking the effectiveness of these rights as well as a proposed solution to these conflicts
