Resumo: This paper aims to explain the importance of the guarantee insurance, as well as its evolution in the Brazilian legal system, its regulatory aspects, advantages of contracting and regulation of their use in judicial enforcement proceedings (tax enforcement proceedings). The paper also analyze the possibility of replacing other guarantees by guarantee insurance, in accordance to the Federal Law nº 13,043/2014 (which amended Federal Law nº 6.830/1980), that equating the guarantee insurance to bank guarantee and enabling their use in tax enforcement proceedings. Also, this paper analyzes the new article 835, § 2nd, of the Civil Procedure Code (Federal Law nº 13.105/2015), which brought a major legislative advance, by treating the letter of guarantee and the guarantee insurance like a money, in an amount not less than plus 30% (thirty percent). This paper was based on bibliographic research focused on legislation and regulation of the guarantee insuranceO presente trabalho tem por objetivo demonstrar as características gerais do seguro garantia, a evolução do instituto no ordenamento jurídico Brasileiro, seus aspectos regulatórios, liquidez, formas de contratação, vantagens de sua contratação, bem como a regulamentação de sua utilização no âmbito dos processos executivos judiciais (execução fiscal). O trabalho também aborda a possibilidade de substituição de outras garantias pelo seguro garantia, haja vista o advento da Lei nº 13.043/2014 que alterou a Lei nº 6.830/80, equiparando-o à fiança bancária e viabilizando a sua utilização no processo executivo fiscal. A inclusão do § 2º do artigo 835 ao novo Código de Processo Civil (Lei nº 13.105/2015), trouxe um importante avanço legislativo ao equiparar a carta de fiança bancária e o seguro garantia a dinheiro, desde que em valor não inferior ao do débito indicado na petição inicial, acrescido de 30% (trinta por cento).
