Resumo: Territorial disputes in the South China Sea have made the region the scene of one of the most important legal conflicts of our time. Parties to this conflict are the People’s Republic of China, Taiwan, the Republic of the Philippines, Malaysia, the ation of Brunei Darussalam and the Socialist Republic of Vietnam. The reasons for this dispute involve economic reasons, since the individual geography of the region is very rich, being an important trade route, as well as being fundamentally strategic for all the nations that surround it. These countries in turn claim the right over their waters. China is the most important country in the dispute, using its military and economic power to obtain the right over this region. The legal instrument applicable in this context is the United ations Convention on the Law of the Sea, but several issues involve the effective action of this instrument in the region. Thus, the central objective of the work is to analyze the disputes that currently occur in the South China Sea under international law, seeking to answer the extent to which the Chinese expansion is legal within the norms, for this we need to understand the claims made by the states involved in order to understand how the International Court of Law of the Sea can act for dispute settlement and what is the importance of this instrument for the good resolution of the conflict

São partes desse conflito a República Popular da China, Taiwan, a República das Filipinas, a Malásia, a ação de Brunei Darussalam e a República Socialista do Vietnã. Os motivos para essa disputa envolvem razões econômicas, uma vez que a geografia individual da região é muito rica, sendo um importante rota comercial, além de ser fundamentalmente estratégica para todas as nações que a circundam. Estes países por sua vez, reivindicam o direito sobre suas águas. A China, é o mais importante país na disputa, utilizando do seu poder militar e econômico para obter o direito sobre essa região. O instrumento jurídico aplicável nesse contexto é a Convenção das ações Unidas sobre o Direito do Mar, porém várias questões envolvem a efetiva ação desse instrumento na região.
