Resumo: This work deals on the importance attached to fundamental rights by the Brazilian‟s legal system, what is Social Dumping, the importance of adopting measures that can prevent this practice and the instrument whereby the problem is tackled - the social clause. The relevance of the discussion proposed is the timeliness of the theme and the trend of the international market in suppressing the rights of the most vulnerable pole – the workers - in the name of the increase in profits. As a base for the preparation of this study, we sought to doctrinal definition of the issues related to the theme, the historical and contemporary study of international institutions responsible for the international development of guidelines and treaties and the search for jurisprudence and materials to demonstrate the real face of the problem proposal and contextualize the discussion to the reality experienced

A pertinência da discussão ora proposta é a atualidade do tema e a tendência do mercado internacional em suprimir os direitos do pólo mais vulnerável – os trabalhadores – em nome da majoração dos lucros.
