Resumo: Teleworking is a kind of remote work. Law no. 13.467/2017 (Labor Reform) inserted arts. 75- A to 75-E in CLT that deal specifically with teleworking. That is, it is relatively recent legislation. Faced with the pandemic triggered by COVID-19, in 2020, teleworking gained prominence and momentum, as it proved to be a possible measure for maintaining jobs and preventing the spread of the coronavirus. Provisional Measure no. 927/2020, which relaxed some formalities for the immediate adoption of the teleworking regime. This study aims to analyze the historical evolution, the concept and the legislation on the theme. In addition, the role of technological advancement, the advantages and disadvantages of teleworking will be addressed. Still, the applicability of item III in art. 62 inserted by Law no. 13.467/2017, as well as the impacts of the absence of limitation of working hours. This is because there is a tendency for working conditions to become precarious due to the indiscriminate application of the said legal provision. However, apparently, through the application of the legislation considering the context of the specific case, it is possible to establish a teleworking regime with good faith, balance and protection of the dignity of the worker

A Lei n. 13.467/2017 (Reforma Trabalhista) inseriu os arts. 75-A à 75-E na CLT que tratam especificamente sobre o teletrabalho. Ou seja, trata-se de legislação relativamente recente. Diante da pandemia desencadeada pela COVID-19, no ano de 2020, o teletrabalho ganhou destaque e impulso, eis que se mostrou como uma possível medida para manutenção de empregos e prevenção à disseminação do coronavírus. Inclusive houve a edição da Medida Provisória n. 927/2020 que flexibilizou algumas formalidades para adoção imediata do regime de teletrabalho. O presente estudo objetiva analisar a evolução histórica, o conceito e a legislação sobre o tema. Além disso, será abordado o papel do avanço tecnológico, as vantagens e desvantagens do teletrabalho. Ainda, será discutido a aplicabilidade do inciso III do art. 62 inserido pela Lei n. 13.467/2017, bem como os impactos da ausência de limitação da jornada de trabalho. Isso porque, há uma tendência das condições de trabalho serem precarizadas pela aplicação indiscriminada do referido dispositivo legal.
