Dispensa coletiva: análise dos aspectos relevantes anteriores e posteriores à reforma trabalhista (Lei 13.467/2017)

The present study approaches the main aspects of the different modalities of the labor contract termination, marking them with the constitutional principles that deal with the matter. The main objective is to reflect on the issue of collective dismissal, focusing on the Federal Constitution and international norms that seek to protect the employee. The mass termination is analyzed prior innovations brought by Law 13.467/17 - when there was no regulation in this sense, only decisions of the Regional Courts and the Superior Labor Court - and after the labor reform, which, despite the positivization, the theme still lacks adequate treatment. Some examples are also presented in the foreign legislation, as well as criteria adopted by them that can help the Brazilian legislator. The study concludes by the imperfections of art. 477-A of the CLT, since it grants wide authorization for collective dismissal, without having criteria and parameters that avoid or reduce the devastating effects of mass termination, prescinding any act by the professional syndicate
