Resumo: The fraud execution is a procedural institute that presents certain special characteristics and requirements that make it different from the fraud against creditors. Aiming at the protection of the creditor, its recognition makes the fraud act against the same creditor ineffective, allowing, therefore, that the sold or alienated estate be granted to the creditor, according to the provisions of article 593, items I, II and III of the Civil Procedure Code and other laws. Initiating with the study of the estate responsibility, we go through the definition of fraud, differentiating the fraud execution from the fraud against the creditors, its specific requirements, the legal provision of fraud execution in different types of laws and, in the end, the jurisprudential positioning related to the main topics of the research. Iniciando com o estudo da responsabilidade patrimonial, passamos à definição de fraude, a diferenciação entre fraude à execução e fraude contra credores, seus pressupostos específicos, a previsão legal de fraude à execução em leis extravagantes e, finalmente, a posição jurisprudencial sobre os principais pontos referentes ao tema.
