This study aims to verify how is guaranteed freedom of expression in the Brazilian electoral periods, aiming to clarify the right to freedom of expression is mitigated. To achieve this purpose, we begin our investigation by the study of freedom and freedom of expression within their various legal and philosophical concepts. Moreover, to verify if there are possibilities for mitigation, we will be able to analyze and clarify, through the empirical data analysis obtained through certain selected judged, as is (are) applied technique for collision-off between fundamental rights. We also understand what is an election period and the current sense of freedom of expression in this period, after which we proceed with a study on the relationship between electoral period and what the current electoral legislation advocates about the freedom of expression, bringing, including evidence, by means of devices that electoral legislation concerning the theme. Therefore, it is a descriptive study of bibliographic and documentary slant. The investigation provided and clarified through empirical data obtained from a trial selected, how the application of techniques to the solution of collision between fundamental rights. We conclude that freedom of expression is not absolute right, not even in electoral periods. However, the limitation of freedom’s expression against other rights and fundamental guarantees must be analyzed from each case, in particular, and through the application of the rule of proportionality
