Resumo: The present project has as its object of study the practice of constricting measures imposed to the taxpayer as a form of coercion to the payment of supposed tax debt. Establishes a definition for the concepts of tax sanction and “policy sanction” and identifies it´s major elements. Approaches the violations that arise from this practice, focusing on the principles of the free exercise of economic activity and the due process of law. Analyzes former court decisions form the Supreme Court and criticizes the latest precedents which establishes new elements for the characterization of the political sanctions. Presents current cases of restrictions and analysis of the constitutionality of the measures imposed. It concludes that any restriction imposed to the taxpayer as coercion to the payment of tax debt is unconstitutional. It is sufficient to characterize the policy sanction the noncompliance to the due process of law

Estabelece uma definição para os conceitos de sanção tributária e de “sanção política” e identifica os seus principais elementos. São abordadas as violações decorrentes de sua prática, com foco nos postulados do livre exercício da atividade econômica e do devido processo legal. Analisamos a jurisprudência do Supremo Tribunal Federal sobre o tema e fizemos uma crítica aos julgados mais recentes que traçam novos requisitos para a caracterização das sanções políticas. Apresentamos casos recorrentes de restrições e analisamos a constitucionalidade das medidas impostas. Concluímos que qualquer medida restritiva imposta ao contribuinte como forma coercitiva ao pagamento de tributo é inconstitucional.
