Society is evolving and moving, and this movement, new needs, new technologies and services, which not infrequently produce accidents, risks and inconvenience for the population to a greater or lesser degree. Such social and economic vitality also requires a constant improvement and modernization of the legal system. For this reason, it is said that the law is dynamic, even the Labour Law. The liability in accidents at work is studied in doctrine from the standpoint of subjective and objective theories, coupled with the theory of risk in economic activity. In this context, we designed this study in order to analyze the relationship of employment, the concepts of occupational accidents and diseases, summarizing the characteristics of the liability of employers for such misfortunes in order to demonstrate, by all legal aspects, the Future trends regarding the liability of the employer without the required proof of guilt. The fact, circumstances, and not to blame, become every day the most important element that arises the duty to repair the damage caused to the employee, which involves radical way in respect of civil liability in labor
