Resíduos sólidos e a economia circular no Brasil: a logística reversa de embalagens e os desafios de sua aplicação

This dissertation analyzed the reverse logistics system for packaging in general in Brazilian legal instruments, verifying the possibility of fully implementing a circular economy in Brazil, as well as understanding the challenges related to its implementation, compliance with and inspection. It was based, therefore, on the bibliographic method (through the analysis of doctrinal texts, journalistic news, scientific articles, legislation and jurisprudence), and inductive method (since, from the bibliographic analysis it was possible to reach a conclusion regarding the viability of the efficient operation of the packaging reverse logistics system). Through this methodology, it was verified whether the current instruments for implementing such system (Sectoral Agreement and commitment terms, in particular those signed in the State of São Paulo) have proven to be sufficient and whether there is a possibility of fully implementing a circular economy in Brazil by respecting reverse logistics standards and seeking to redefine the notion of economic growth. Problems related to the judicialization of the Sectoral Agreement and the difficulties related to the fulfillment of its goals will also be analyzed. The relevance of this research translates into the fact that we are experiencing a critical moment regarding sustainability, considering that the current linear economic model is based on production and waste, so that it is reaching its physical limit. In this context, the circular economy appears as an alternative, through the reaffirmation that current resources are finite, requiring the reduction of waste generation and the regeneration of natural systems. Thus, reverse logistics is presented as one of the main mechanisms of the circular economy, since its actions enable the collection and return of solid waste to its origin, aiming at its reuse, in its own cycle or in other productive cycles
