Resumo: This paperwork has the scope, starting from a historical analysis of the law of evidence, to do some considerations about the influences and development of the law of evidence in the Brazilian Civil Procedure Law, ending in the draft of the New Code of Civil Procedure Law, which is still awaiting enactment. The Draft of the New Code of Civil Procedure brings significant increase of the instructive powers of the judge and, more than that, the possibility of flexibilization of the obligation of proving by using the "Theory of Dynamic Loads of Evidence", developed in Argentine law. Even used in a subsidiary way and by the presence of specific assumptions, the "Theory of Dynamic Loads of Evidence" will bring to the citizen a manner to have a qualitative and effective protection, and shows a respect to the contemporary trend of constitutionalization of civil procedure, especially the principles carved in article 5, sections XXXV, LXXVIII, LV, of Brazilian Federal Constitution
