Resumo: The main objective of this work is to provide a theory that systematizes the multiple standards of legal reasoning observable in the application of constitutional rights norms. For this purpose, some secondary objectives will be fulfilled. Firstly, the introduction of logical and formal instruments that are sufficient for the presentation of premises and logical inferences employed within complex constitutional arguments. Secondly, the development of the formal structure of constitutional rights norms, in order to make explicit their deductively relevant components. With this apparatus, the structures of different standards of legal reasoning will be elaborated, and the forms of concatenation of arguments analyzed. The results will then be tested in the light of real legal arguments, and, finally, the degree of systematicity reached by the theory, critically evaluated. The research method will be predominantly deductive, by means of bibliographic research, but with occasional references to legal precedents inductively collected from Brazilian Constitutional Law, in order to confront such precedents with the results achieved by the theory

Para isso, alguns objetivos secundários serão cumpridos ao longo do estudo. Primeiramente, a introdução de um instrumental lógico-formal suficiente para a exposição das premissas e inferências lógicas empregadas no curso de argumentos complexos na esfera constitucional. Em seguida, o desenvolvimento da estrutura formal das normas de direitos fundamentais, a fim de explicitar seus componentes dedutivamente relevantes. Com esse aparato, os padrões argumentativos serão expostos em sua estrutura para, em seguida, se analisar as formas de encadeamento desses argumentos. Os resultados obtidos serão testados à luz de argumentos jurídicos reais, e, ao final, o grau de sistematicidade alcançado pela teoria será avaliado criticamente.
