With the tutelar scope to make the human rights effective, several are the international treaties, and for the signatory States, the duty to ensure such rights, in the sphere of their territories, in a way that the major vector is the strict compliance with the International Law general principles. It was the way that the Brazilian State took action to inscribe the fundamentals of its social rights into its Constitution from 1988, the right for social security, in a way to reduce the social risks in order to obtain social wellness. Nevertheless, the effectiveness of the civil rights claim positive actions from the State, demanding public resources, such as international diplomas, i.e. International Pact about the Economic, Social and Cultural Rights, propose a progressive implementation of these kind of human rights. The State exists to satisfy public needs, therefore, must be most prudent as possible regarding to public budget not to skip with your obligations. Furthermore, there are internal duties, demanded by Constitution, and external, established in international treaties that must be obeyed
