This work aims, treat the right to family life in the Federal Constitution of 1988, its appearance in the Brazilian legal scenario, as well as its importance to the healthy development of children and adolescents. The family life is of paramount importance to the welfare of a child and teenager, so much so, that was placed in our Constitution as a fundamental right and should porting this right be respected throughout the legal system. The importance of this right is huge, because it reaches the beings who are in a peculiar development process, and the lack of this law could result in serious consequences in the life of a child. Although, the right to family life is a fundamental right, constitutionally guaranteed and should be respected by the legal system, you can check in infra Law 11,698 / 2008, which amended Article 1584, paragraph 4 of the Civil Code, a disregard of that right . The above article provides for an alleged punishment to parents who break shared or unilateral guard clause, thus possibly sanction the restriction on the number of hours of interaction with the child (a), however this penalty contravenes the right to family child because it is a right and not her parents. Thus, contrary to the constitutional dictates by such paragraph, should be considered unconstitutional, since the right to family life is a fundamental right that must be protected and respected throughout the legal system
