This study has the main objective of presenting the theory of Richard Posner, about the maximization of the wealth from judicials decisions, called as well análise economical analyses of the law. Initially, the ethical and political foundations of wealth maximization are discussed, with emphasis on the relationship between this and justice, among other aspects. Later, the theory of Ronald Dworkin is presented, strongly confronting the arguments espoused by Posner about the maximization of social wealth through the work of judges in lawsuits. Next, further study is done on Dworkin's theory of rights, emphasizing the rights as limiting of conduct, Dworkin policy, minority rights and the prevalence of Dworkin's theory of Posner's theory on the maximization of wealth, still showing the importance of rights guaranteed in legal instruments, as well as its proper application to concrete cases through rules and principles
