Resumo: The present undergraduate thesis aims to delve into the institute of defensive investigation, bringing fundamental elements of the accusatorial system. In this sense, elements of the legal system, such as the Federal Constitution and the Code of Criminal Procedure, will be brought in to outline the institute and its purposes. Similarly, this study also relies on the examination of crucial normative instructions for discussion, such as Provision No. 188 of the Federal Council of the Brazilian Bar Association and the Pact of San José of Costa Rica. Furthermore, this work will also seek foundation through foreign legislations, which may directly influence the institute of defensive investigation in Brazil
