Resumo: The purpose of this paper is to study the most relevant aspects of subpoena procedure and the formal establishment of the debtor’s delay in the execution of fiduciary alienation contracts in real estate collateral, in order to better understand the extrajudicial enforcement procedure implemented by Law 9.514, from 20 November 1997, with the analysis of the main validity requirements, which is an important matter that reflects the legal certainty in propert transactions using funding from the real estate market. The research is based on legislation, doctrine, periodic legal magazine and jurisprudence. The main conclusions show that extrajudicial execution, especially the subpoena procedure, are in tandem with the constitutional principles of due legal process, the contradictory, and the ample defense, which is revealed by the rigor of the law to constitute the debtor in arrears in the subpoena procedure, which makes this institute a swift, safe, efficient and effective legal instrument in the resolution of conflicts and social pacification

A pesquisa está baseada na legislação, doutrina, revista jurídica periódica e jurisprudência.
