This present essay focus on the instruments created by the Federal Constitution of 1988 to control unconstitucional legislative omissions that interfere in the effectiveness of constitucional norms with limited efficacy, whose aplicability depends on ordinary legislation. At first, it proposes an analisis of human rights evolution through history until the origin of the institutes, objects of this study. Next, it will examine the differents classifications about the aplicability of constitucional norms, when we will choose the one that is most apropriate to the objectives persuted in this work, followed by a detailed study about the unconstitucional legislative omissions. At last, it will be made a profound study of the legal matters that surround the institutes of direct action of unconstitucionality by omission and the writ of injuction, oportunity in wich it intents to show their differences and demonstrate the incontestable importance of both in our legal system
