This paper aims to analyze the criminal responsibility of physicians in cases of obstetric violence. Violence against women at the time of childbirth is an ancient and institutional- ized phenomenon, even though the term “obstetric violence” hás only recently began to surface, as a recognition that violence practiced by physicians against pregnant women is not normal and that situations of violence should not be tolerated. This paper intends to present a history of women rights in Brazil, up to the present day, analyzing how the Law works in Brazil when it comes to violence against women. Also, this paper will con- ceptualize and and exemplify cases of obstetric violence, and also analyze the Brazilian legal system regarding women rights in the moment of childbirth. Finally, we will outline the criminal responsibility of physicians in cases of obstetric violence, showing what types of crimes may occur in the context of obstetric violence, and explaining when the physician may be criminally responsible for his or her conduct
