Resumo: | The present paper seeks to analyze the institution of criminal confession from the perspective of the rights established in the Constitution of the Federative Republic of Brazil, and its major effects on the individualization of punishment. Therefore, it addresses all the historical context before the emergence of this provision, as well as all the surrounding uproar, tracing the long way to which this right was recognized. Within the theme confession we will discuss about the features, its requirements and, of course, the doctrinal concept that best applies, all based in the prism of constitutional principles, specifically the due legal process, extensive and contradictory defense and the right to silence. It will be highlighted also relevant aspects around the discussion of the legal nature of the criminal confession, defending the position that it is a evidence and due reverence, refuting other currents. Nevertheless, starts the study of individualization of punishment, listing some topics and concerning ideas, going through legislative phase and execution of the sentence, the court focused on individualization, especially in its first phase, when setting the magistrate and penbased his analysis of the circumstances surrounding the court (Article 59 of the Criminal Code). For ultimate, interconnecting criminal confession and individualization of punishment, invoke the argument about the relevance of the study of the fundamentals of confession (what leads the defendant to confess?), to the defense of that confession is not just as mitigation of sentence, should be properly regarded as a personality favorable to the defendant, when to perform this spontaneously and with signs of repentance of the commission of the offense. This discussion becomes relevant at various points, protecting the principle of equality in its material aspect. Specifically, starting from the last argument above also defend the possibility of compensation between confession and spontaneous recurrence away from the purely literal analysis of Article 67 of the Penal Code |

Para tanto, aborda todo o contexto histórico antes do surgimento desta disposição, bem como toda celeuma envolvente, traçando o longo caminho percorrido para que tal direito aos poucos fosse sendo reconhecido. Dentro do tema confissão discorreremos a respeito das características, seus requisitos e, obviamente, o conceito doutrinário que melhor se encaixa no atual estágio processual penal que vivenciamos, tudo com base nos princípios constitucionais, mais especificamente: o devido processo legal, a ampla defesa e o contraditório e o direito ao silêncio. Evidenciaremos, também, aspectos relevantes em torno da discussão acerca da natureza jurídica da confissão penal, defendendo-se o posicionamento de que se trata um meio de prova e, com a devida vênia, refutando-se as demais correntes. Não obstante, adentraremos ao estudo da individualização da pena, enumerando alguns tópicos e ideias concernentes, passando pela fase legislativa e de execução daquela, nos focando na individualização judicial, principalmente em sua primeira fase, quando da fixação pelo magistrado da pena-base e sua análise em torno das circunstâncias judiciais (artigo 59 do Código Penal). Por derradeiro, interligando a confissão penal à individualização da pena, invocamos a argumentação sobre a relevância do estudo dos fundamentos da confissão (o que leva o réu a confessar?), objetivando a defesa de que a confissão não serve apenas como atenuante da pena, devendo ser devidamente considerada como personalidade favorável ao réu, quando este a realizar de forma espontânea e com sinais de arrependimento do cometimento do delito. Tal discussão se torna relevante em vários pontos, resguardando-se o princípio da igualdade em seu aspecto material.
