Resumo: As an introduction, will be traced a brief history about the relation between capital and labor force, since the mercantilism era until nowadays, with the preponderant role of globalization. Initially, will be analyzed the conception of labor law as a subtype of human rights, inserted in the list of social rights. Next, will be studied the concept of social dumping and its negative effects for human rights of workers, as well as the international trade free competition, specially the Chinese case. After, will be examined which international organization is competent to regulate and restrain the present subject, the International Labour Organization or the World Trade Organization. Lastly, will be suggested possible ways for combat this situation and the problems generated by it

Lastly, will be suggested possible ways for combat this situation and the problems generated by itAntes de adentrar no estudo propriamente dito, será traçado breve histórico sobre a relação capital e mão de obra, desde o mercantilismo até os dias atuais, com o preponderante papel da globalização. Iniciar-se-á o texto com a análise da concepção do direito do trabalho como parte integrante dos direitos humanos, inserido no rol dos direitos sociais, e os reflexos que esse status confere à tutela das garantias laborais. Em seguida, será abordada a questão do dumping social e os efeitos nocivos dessa prática para os direitos humanos dos trabalhadores, bem como para a livre concorrência no comércio internacional, perpassando-se rapidamente sobre o caso da China. Posteriormente, passará a ser esquadrinhada a questão sobre a competência para regular e coibir o presente assunto, analisando-se a OIT e a OMC.
