Gestão da cultura e do conhecimento organizacional: um estudo aplicado à gestão de tribunais de justiça

Resumo: Courts of law play an important role in society, and have aroused interest from various fields of knowledge, specifically in the field of administration, we can see the growing structure of knowledge about court management. The movement of the new public management has influenced the modernization of the Judiciary Power in Brazil and in the world, as a consequence, there has been the implementation of mechanisms for managing courts of law that are closer to business management methods. That said, court management has increasingly integrated disciplines and concepts that were once exclusive to private organizations. As something natural of a knowledge creation process, gaps can be identified that provide us with opportunities to contribute. In this sense, the themes of organizational culture and knowledge management have received little attention from researchers in the context of courts of law, since in previous research, courts were characterized as knowledge-intensive organizations and that organizational culture is related to the performance of organizations, furthermore, the literature reveals that organizational culture is a major challenge for effective knowledge management, justifying and confirming the relevance of this study. Thus, this research aims to verify the relationships between organizational culture, knowledge management and the benefits for the organization of knowledge management results. To achieve this goal, a review of the theoretical foundation involving organizational culture, knowledge management and court management was developed. The methodological strategy consists of adopting a quantitative approach for research and a qualitative approach for analyzing the results. The research model is defined by examining the relationships between variables, the variables will be measured by instruments allowing the analysis of numerical data through statistical procedures. The statistical model was based on essentially exploratory multivariate methods, with the development of structural equation modeling based on variance. Data collection was performed using an online questionnaire, in the largest court of law in the country. Five hypotheses were generated, three about the relationships between the constructs, one about the mediation effect and one about the moderation effect. 7,784 questionnaires were distributed, with 2,891 completed questionnaires being returned, 1,719 being validated. The results indicate the confirmation of the five hypotheses of the study, which can be highlighted that the relationship between organizational culture and knowledge management is positive with a path coefficient of 0.684 and significant at a level of 5% with p-value less than 0.005. The research contributed to the increase in the structure of knowledge about organizational culture and knowledge management in the field of managing courts of law. The research also provides a set of contributions for court managers interested in the topics of intentional management of organizational culture and knowledge

O movimento da nova gestão pública tem influenciado a modernização do Poder Judiciário no Brasil e no mundo e, em consequência, a implementação de mecanismos de gestão de tribunais de justiça mais próximos dos métodos de gestão de negócios. Isto posto, a gestão de tribunais cada vez mais tem integrado disciplinas e conceitos antes exclusivos das organizações privadas. Como algo natural de um processo de criação de conhecimento, identificam-se lacunas que propiciam oportunidades de contribuição. Nesse sentido, os temas cultura organizacional e gestão do conhecimento têm recebido pouca atenção dos pesquisadores no contexto dos tribunais de justiça, uma vez que, em pesquisas anteriores, os tribunais foram caracterizados como organizações intensivas em conhecimento, sendo a cultura organizacional relacionada ao desempenho das organizações. Além disso, a literatura revela que a cultura organizacional é um grande desafio para a gestão do conhecimento eficaz, justificando e confirmando a relevância deste estudo. Assim, a presente pesquisa tem como propósito verificar os relacionamentos entre cultura organizacional, gestão do conhecimento e os benefícios para a organização dos resultados de gestão do conhecimento. Para atingir esse objetivo, foi desenvolvida a revisão da fundamentação teórica envolvendo cultura organizacional, gestão do conhecimento e gestão de tribunais. A estratégia metodológica compõe-se pela adoção de abordagem quantitativa para a pesquisa. O modelo de pesquisa define-se pelo exame de relações entre variáveis, sendo essas medidas por instrumentos, permitindo a análise dos dados numéricos por meio de procedimento estatísticos. O modelo estatístico foi baseado em métodos multivariados essencialmente exploratório, com desenvolvimento de modelagem de equações estruturais baseada em variância. A coleta de dados foi realizada por meio de aplicação de questionário online, no maior tribunal de justiça do País. Foram geradas cinco hipóteses, sendo três sobre os relacionamentos entre os constructos, uma sobre o efeito de mediação e outra sobre o efeito de moderação. Foram distribuídos 7.784 questionários, com retorno de 2.891 questionários preenchidos, sendo validados 1.719. Os resultados indicam a confirmação das cinco hipóteses do estudo, destacando-se que a relação entre cultura organizacional e gestão do conhecimento é positiva com coeficiente de caminho de 0,684 e significativo a um nível de 5% com valor-p menor que 0,005. A pesquisa contribuiu para o aumento da estrutura de conhecimento sobre cultura organizacional e gestão do conhecimento no campo da gestão de tribunais de justiça.
