This work presents the study on the competence for the institution of the Metropolitan Regions, as well as the ownership of the services of public transportation of passengers. The theme choice is justified because of the difficulty of the matter in face of constitutional competences - local interest versus common interest - and its reflection on the Metropolitan Regions institution. For the preparation of the present work - which involved research and examination of doctrine and jurisprudence – it was analyzed the federative principle and its constitutional evolution; the distribution of federative competencies; the conceptualization of common and local interest; the analysis of the ownership of services involving metropolitan interest; the recognition of the State as holder of the public passenger transport service in the intermunicipal area, as well as the integrative difficulties of considering the Municipality as this service owner, when provided within the internal limits of cities that are part of the Metropolitan Region
