Resumo: The present work analyzes The Guarantee of the Fiduciary Alienation of Real Property in the Contracts of Debt Confession, seeking to know the academic concepts of the institute and those developed among the Brazilian doctrinators. The research deals with the subjective and objective requirements of the institute, the parties, the object, its form of constitution, as well as the rights and obligations arising from this act. It explores the species of existing fiducias, the legal nature and its regularization in the Brazilian Law. It also impedes the unenforceability of the family property when it is used as a form of guarantee, the essential clauses of the guarantee under consideration after observing applicable legislation and its forms of extinction. The application of the guaranty in question to the Debt Confession contracts where there is the recognition of a fact or a debtor's debt in favor of the creditor that will need a guarantee in order to comfort and assure the interests of the parties attributing the confession of debt the nature of an extrajudicial enforcement order

A pesquisa trata dos requisitos subjetivos e objetivos do instituto, as partes, o objeto, sua forma de constituição, bem como os direitos e obrigações advindos deste ato. Explora as espécies de fidúcias existentes, a natureza jurídica e sua regularização no Direito Brasileiro. Aborta também a impenhorabilidade do bem de família quando o mesmo é utilizado como forma de garantia, as cláusulas essenciais da garantia ora estudada uma vez observada legislação aplicável e suas formas de extinção.
