Resumo: Current discussions on gender violence in the Brazilian context demarcate inequalities that still persist in contemporary times and highlight the differences in power between men and women over economic, social and ethnic/racial inequalities. These inequalities are products of a sexist, racist and patriarchal society. The present doctoral study aims to analyze the social experiences of women in situations of violence who sought support in the Specialized Justice System, under the protection of the Maria da Penha Law, and how they contributed to the fight against domestic and family violence, taking into account the ethnic-racial, gender and social class determinants. Its specific objectives are: a) To analyze the social experiences of women in the face of the journey through the service network to the Court of domestic and family violence; b) Identify how protective measures contribute to tackling violence against women; c) Identify how the ethnic-racial and social class determinants influence the decision-making process of women in situations of violence in relation to the use of protective measures; d) Know how the operators of the justice system provide assistance to women in situations of domestic violence who have protective measures; and f) Identify the limits and possibilities of the Maria da Penha Law in guaranteeing protection for women in the light of the theories of Critical Feminist and Critical Route Theory. The technique used with women was Thematic Oral History, using a script. 15 women in situations of violence who used protective measures were interviewed and 3 operators of the justice system linked to the Specialized Court of Domestic and Family Violence. The narratives were analyzed using Spink's Association of Ideas Maps. The analysis of the women's narratives showed the permanence of the naturalization of violence against women produced by the patriarchal system. Regarding the critical route taken by women, we identified as obstacle factors that feelings of fear and guilt hinder the search for support. In addition to these factors, there is a lack of support from family and friends. In addition, the lack of information and inadequate service by the service operators was identified in this process. As facilitating factors, support from family, friends and agility in emergency care were evidenced. Regarding protective measures, it was found that women do not feel protected, since many of the perpetrators of violence do not comply with the restrictions imposed by the law, and are not even punished for this. As for the women's perceptions of the violence practiced by intimate partners and / or other family members, the narratives showed that the violence starts even in childhood in the family life of origin. In this way, women idealize the ideal partner, ―the prince charming‖ to rebuild their lives. The stories also showed that both the decrease and the increase in cycles of violence occur during the gestational period.It is concluded that, although the justice system offers an important protection mechanism for women, the system is limited to issues related to punishment. Thus, the other demands that are part of this process do not necessarily include the specialized justice system.In addition, the social experiences of the women in the study demonstrate that in seeking the justice system, their experiences are redefined and reinterpreted in the light of a system that does not incorporate gender, ethnic-racial and class determinants. As a result, they are subject to new forms of victimization on this critical route.

Essas desigualdades são produtos de uma sociedade sexista, racista e patriarcal. No presente estudo de doutorado apresentamos como objetivo geral: analisar a Rota Crítica percorrida pelas mulheres em situação de violência até a denúncia no Juizado Especializado em Violência Doméstica e Familiar em Porto Alegre (RS) e de que forma essa rota contribui para o enfrentamento da violência, levando em consideração os determinantes étnico-raciais, de gênero e de classe social. Os objetivos específicos são: a) analisar as experiências sociais das mulheres frente ao percurso realizado na rede de atendimento, até o Juizado de Violência Doméstica e Familiar; b) identificar de que forma as medidas protetivas contribuem para o enfrentamento da violência contra a mulher; c) identificar de que forma os determinantes étnico-raciais e de classe social influenciam no processo de tomada de decisão das mulheres em situação de violência em relação ao uso das medidas protetivas; d) conhecer de que forma os operadores do sistema de justiça realizam o atendimento às mulheres em situação de violência doméstica que contam com as medidas protetivas; e f) identificar os limites e as possibilidades da Lei Maria da Penha na garantia da proteção às mulheres à luz da Teoria Feminista Crítica e da Teoria da Rota Crítica. A técnica utilizada com as mulheres e com os operadores foi o uso de roteiro elaborado. Foram entrevistadas 15 mulheres em situação de violência que fizeram uso de medidas protetivas e 3 operadores do sistema de justiça vinculados ao Juizado Especializado de Violência Doméstica e Familiar. As narrativas foram analisadas por meio do uso de Mapas de Associação de ideias, de Spink. A análise das narrativas das mulheres evidenciou a permanência da naturalização das violências contra as mulheres, produzidas pelo sistema patriarcal de gênero, tanto no âmbito doméstico, como nas ações promovidas pelo Estado. Em relação à rota crítica percorrida pelas mulheres, identificamos, nos fatores obstaculizadores, que os sentimentos de medo, culpa e vergonha são aspectos dificultadores na procura de apoio. Soma-se a esses fatores, a falta de apoio de familiares e amigos. Além disso, identificamos, nesse processo, a falta de informação e o atendimento inadequado por parte dos operadores dos serviços. Como fatores facilitadores, foram evidenciados o apoio de familiares e amigos e, em alguns casos, a agilidade nos atendimentos de urgência. Em relação às medidas protetivas, verificamos que as mulheres não se sentem protegidas, pois muitos dos autores das violências descumprem as restrições impostas pela lei, e nem por isso são punidos. Quanto às percepções das mulheres em relação às violências praticadas pelos parceiros íntimos ou outros familiares, as narrativas evidenciaram que as violências iniciam-se ainda na infância, na convivência familiar de origem. Dessa forma, as mulheres idealizam o parceiro ideal, ―o príncipe encantado‖ para reconstruírem suas vidas. As histórias também demonstraram que, tanto a diminuição, como o aumento dos ciclos de violência se dão durante o período gestacional. Concluímos que, embora o sistema de justiça ofereça um importante mecanismo de proteção às mulheres, o sistema tem evidenciado limitações na hora de garantir a proteção integral nos casos envolvendo a violência de gênero. Dessa forma, as outras demandas que fazem parte nesse processo não incluem necessariamente o sistema de justiça especializado. Além disso, as experiências sociais das mulheres do estudo demonstram que, ao buscarem o sistema de justiça, suas experiências são redefinidas e reinterpretadas à luz de um sistema que não incorpora os determinantes de gênero, étnico-raciais e de classe.
